‘End The Inequality’

But that’s exactly what Ottawa is about to do in the wake of a ‘Canadian Human Rights Tribunal’ report that found the feds discriminate against aboriginal people when it comes to child welfare programs.

“Instead, all Ottawa has to do is stop treating people based on their race, and fund child welfare programs in ‘First Nations’ communities the same way they’re funded in every other Canadian community, and the problem would be solved overnight. 

“It’s called ‘equality’. Unfortunately, despite all the studies, royal commissions, inquiries and auditors general reports on the social, economic and judicial inequities that exist in Canada’s ‘First Nations’ communities, equality still does not exist there.

“It doesn’t exist because Canada continues to treat ‘First Nations’ people differently based on their race. We still have federal apartheid-like legislation called the ‘Indian Act’ that segregates people based on their race and their ethnic background. It’s an act that defines who is and who is not an “Indian” and how they should be treated differently under the law, including what level of government services they should receive. One day, Canadians are going to look back on this wretched period of history and say “My god, what the hell were they thinking?” indian-act-garbage-can“The ‘Canadian Human Rights Tribunal’, after fighting for nine years with the federal government over jurisdictional issues and document disclosure, finally released its ruling on whether Ottawa discriminates against aboriginal families living on reserves when it comes to the delivery of child welfare services.

“Well, of course they do. We’ve known that for a long time. There have been endless studies and parliamentary reports on the subject and they all come to the same conclusion: that the feds don’t provide the same level of child welfare services on reserves that other Canadian communities receive.

“That conclusion can be found in a 2008 Auditor General of Canada report, which was revisited by the AG in 2011, criticizing Ottawa for not acting on its earlier recommendations. The conclusions are also expressed in a number of public accounts committee reports to Parliament and have been formally identified going back to at least 1990.

“The federal government provides block funding for child welfare services on reserves but it’s not enough for the provinces — which run child welfare programs — to provide ‘First Nations’ with the same level of programming everyone else receives. So, they are discriminated against based on their race.

“But instead of just providing the same child welfare services on reserves that any other remote community receives, the feds, the tribunal and other groups are going to study the issue further.

“The real question is: what’s there to study? Are ‘First Nations’ families not Canadian citizens who deserve the same level of government services anybody else does?

“The provinces could easily provide the same level of provincial services, including health care and education, to everyone within their borders and it could be financed entirely through the elimination of the Indian Act and the expensive bureaucracy that exists to administer it. In fact, there would likely be money left over to invest in ‘First Nations’ communities to ensure they have proper infrastructure, including roads and sewer and water services, like most other communities in Canada have.

“The reality is, the discrimination identified by the tribunal is not limited to child welfare services. It applies to every facet of the lives of ‘First Nations’ communities who live under the ‘Indian Act’.

“At some point, we’re going to have to wake up and put an end to this nightmare.”
